Man claims he was sexually assaulted by nurse at Palm Springs Hospital in Hialeah

Rene Martinez, 51, charged with simple battery, unnatural lascivious act

HIALEAH, Fla. ā€“ A 38-year-old man has filed a multimillion-dollar lawsuit against Palm Springs Hospital in Hialeah after he claims he was sexually assaulted by a male nurse.

According to the patient, Rene Martinez, 51, fondled him while he was sleeping and heavily medicated on Sept. 15 in the hospital's emergency room.

He had gone in due to complaints of leg and back pain.

"I was like, 'What's going on?' and he was like, 'I was just checking to make sure you're OK.' That's when I say, 'OK this guy is up to something,'" said the victim.

The victim said he then positioned his cellphone on his shoulder to record Martinez in the act and pretended to fall asleep again.

"He came back, put his hand in my boxers, pulled out my private parts and started playing with it, and I was rolling on him doing it the first time and second time," said the victim.

Martinez was arrested and charged with two counts each of simple battery and an unnatural lascivious act. An act the victim said triggered painful memories of past abuse he endured as a child.

"I'm just hoping he doesn't work at a hospital or any other place to do this to anyone else again."
