Charge dropped against man accused of leaving child alone in Tesla Cybertruck at Aventura Mall

AVENTURA, Fla. – A child neglect charge against a Pennsylvania man accused of leaving a young girl alone inside a Tesla Cybertruck at Aventura Mall nearly three months ago has been dropped, according to court records.

The case against 36-year-old Vadim Fedorovsky, of Reading, Pennsylvania, was officially closed on Feb. 26 by Miami-Dade Circuit Judge William Altfield, records show.

Fedorovsky was arrested Jan. 17 after Aventura police said officers responded to reports of a “small child” left unattended in a silver Tesla Cybertruck parked on the third level of the Macy’s garage at 19545 Biscayne Blvd.

When officers arrived just after 1:30 p.m., they found the truck turned off with the rear left window slightly down and a young girl sleeping in a car seat in the rear right passenger seat, according to the arrest report.

Police said the girl appeared to be breathing and not in distress. A cellphone found in the front seat was still active on a phone call that had reportedly lasted more than 50 minutes, the report stated.

Officers said they unlocked the vehicle, retrieved the phone, and contacted its owner — later identified as Fedorovsky.

They said he was arrested at the scene on one count of child neglect without great bodily harm.

According to a no action memo obtained Monday by Local 10 from the Miami-Dade State Attorney’s Office, the incident involved Fedorovsky’s 3-year-old daughter.

“The parents left the windows partially down and left a cell phone on a video call with the defendant’s phone to monitor the girl via video,” the memo stated. “The defendant and his wife then went into the mall to get a specific item. While they were in the mall, police were called to the vehicle by someone who discovered the child in the car. The police used the phone in the vehicle that was monitoring the girl to have the defendant return to the vehicle. The arresting officer advised that it was a cool day, and the child was not uncomfortable or in any distress; however, the defendant was arrested for Child Neglect.”

Prosecutors noted in the report that no action was taken as the Florida Department of Children and Families “allowed the family to return to Pennsylvania and contact(ed) their sister agency to open a case to monitor the family.”

“My client is grateful that the State Attorney’s Office carefully and diligently considered the facts and applicable law and made the right decision, taking no action on the charges,” Fedorovsky’s attorney, Walter A. Reynoso, told Local 10 News in an email Monday.
