According to the Broward Sheriffā€™s Office, the incident happened just before 5:30 p.m. Tuesday at the chainā€™s location at 1267 S. State Road 7.

Deputies said Dwyarrn Burton, a 32-year-old homeless man, was ā€œopenly masturbatingā€ at a window in view of the restaurantā€™s play area. They said three children were inside.

Broward prosecutors redacted all further information about the incident in the report, citing in part ā€œactive criminal investigation information.ā€

It does state that deputies discovered that Burton had previously been arrested in Massachusetts on a charge of ā€œindecent assault/battery,ā€ but the outcome of that case wasnā€™t known.

Transit police officers arrested him at a Boston train station on Aug. 4, 2019 after they said he ā€œindecently assaultedā€ a woman getting off a subway car.

Just two months later, ABC affiliate WCVB reported that Massachusetts state troopers arrested Burton after accusing him of assaulting a woman on a Boston bike path.

Itā€™s not clear when he moved to South Florida.

Records show that Burton, who is facing three counts of lewd and lascivious exhibition in front of a child under 16 and two counts of indecent exposure, was being held in the BSO Main Jail on a $320,000 bond.
