CUTLER BAY, Fla. – A Cutler Bay man was arrested Monday after he beat up his 70-year-old neighbor who already had a protection order against him, authorities said.

According to an arrest report from the Miami-Dade Sheriff’s Office, the incident occurred around 11:10 a.m. on Jan. 27 in the 18400 block of Southwest 89th Place.
Deputies said the victim was inside his house when he heard the suspect, Gregory Uriarte, 56, screaming outside.
Deputies said the victim looked out the window and saw that Uriarte was yelling at his dog that was loose and had gotten into the victim’s yard.
The victim then told Uriarte not to enter his yard due to the protection order, but Uriarte entered anyway, authorities said.
According to the report, Uriarte’s dog then ran into the victim’s home and the victim instructed Uriarte not to enter his home, saying that he would get the dog for him.
But deputies said Uriarte entered the home anyway to get his dog.
According to the report, the victim then spoke to Uriarte’s father who was standing in the middle of the street, informing him that he had an active protection order against Uriarte and he would be calling police.
Deputies said Uriarte then turned around and “rushed the victim.”
According to the report, the victim pushed Uriarte away, but Uriarte didn’t move and started to scream at the victim.
Deputies said the victim pushed Uriarte away again and told him to get back, but Uriarte clenched his fist and “flinched at the victim,” at which time the victim punched Uriarte.
Deputies said Uriarte then began beating on the victim with his fist, throwing him to the ground and punching him some more.
Uriarte’s father tried to separate the men, but also fell to the ground, authorities said.
Deputies said Uriarte eventually picked his father up and fled the scene in his father’s vehicle.
The victim was transported to a hospital by ambulance and had to undergo shoulder replacement surgery, the report stated.
Uriarte faces charges of battery on a person 65 or older, felony battery and violation of a protective injunction.
As of Tuesday, Uriarte was being held at the Turner Guilford Knight Correctional Center where his bond was listed as “to be set.”
