Homestead man accused of raping intoxicated woman

HOMESTEAD, Fla. – A 32-year-old man from Homestead was arrested over the weekend after he allegedly raped a woman who was intoxicated, authorities said.

According to an arrest report from the Miami-Dade Police Department, the crime occurred at about 2:30 a.m. Saturday at Carlos Diaz Martin’s home in the 500 block of Northwest Second Street.

The victim told officers that she woke up early in the morning, “completely naked and felt like she had sexual intercourse,” the report stated.

Police said the victim told them she did not give consent to have sexual intercourse with anyone and that she last remembered Diaz Martin kissing her without her consent prior to her losing consciousness.

According to the report, officers recovered cellphone video which shows Diaz Martin having sexual intercourse with the victim while she was “physically incapacitated.”

The video was consistent with the victim’s statement to officers, authorities said.

According to the report, the video also showed an unknown female sticking her fingers in the victim’s mouth as she was being raped.

Diaz Martin was arrested the same day on a charge of sexual battery on a physically incapacitated victim. The identity of the female seen in the video remains unknown.
