MIAMI – A Miami man was arrested Friday after entering his estranged wife’s home without permission, armed with a gun, and threatening his daughter’s male companion during a heated confrontation, authorities confirmed Monday.
Miami police said 43-year-old Luis Huben Rocha entered his wife’s residence in the 1200 block of Northwest 28th Street in the city’s Allapattah neighborhood and argued with his daughter’s companion over their relationship.

The victim told officers he was in the living room when Rocha arrived uninvited, racked the gun, and pointed it at him while saying, “You won’t get out of this one” and that he would kill him.
Police said Rocha’s 12-year-old son, told officers that his father handed him a loaded gun, teling him to “put it somewhere,” before he fled the scene.
Rocha’s son told police he heard his father’s threats against his sister’s companion and was later found alone in his room with the loaded gun while officers were investigating the scene. Authorities confirmed that the gun was subsequently secured by the police.
The gun, identified as a SIG Sauer P320, was loaded with 13 rounds and one in the chamber, according to investigators.
Rocha’s daughter, who had been in her room during the incident, said she heard shouting and saw her mother attempting to hold Rocha back, according to an arrest report. She pleaded with her father to relinquish the gun and then retreated to her room to call 911, authorities confirmed.
Police said responding recovered the loaded gun along with an additional 9 mm round on the scene as evidence.
Upon arrival, Miami police said officers saw Rocha jumping through a front window into the residence. Officers said they detained him inside the home without further incident.
Authorities said Rocha, who has been married to his wife for 17 years, is under a court-ordered injunction issued on July 30 and extended on Aug. 15. The injunction prohibits him from contact with her following a domestic violence case, investigators said.
Jail records show Rocha is facing charges of armed burglary, aggravated assault with a deadly weapon and contributing to the delinquency of a minor.
As of Monday, the Nicaraguan national is being held on an immigration hold at the Miami-Dade County Pre-Trial Detention Center.
