Miami-Dade police said Mario Gutierrez Tamayo and the 30-year-old victim were acquaintances and agreed to meet at the park on that date.

But police said once there, Gutierrez Tamayo asked the victim to remove her clothing.

Police said the woman refused, saying they were at a public park, at which time Gutierrez Tamayo allegedly grabbed the back of her pants and pulled her toward him.

According to the report, Gutierrez Tamayo then “forcefully removed the victim’s pants and said, ‘We’re going to do this the easy way or the hard way.’”

Police said he then covered the victim’s mouth and raped her.

According to the report, police were serving a search warrant on Gutierrez Tamayo’s cellphone on Sept. 24 when he initiated a factory reset, which a Miami-Dade police lieutenant witnessed.

Police said he surrendered himself to the MDPD Special Victims Bureau/Sexual Crimes Investigations Unit on Wednesday and was transported to the Turner Guilford Knight Correctional Center.

He faces charges of sexual battery and tampering with physical evidence.

As of Thursday afternoon, Gutierrez Tamayo remained jailed on a $10,000 bond.
