Miami man, 92, accused of touching, trying to kiss 15-year-old boy

MIAMI – A Miami nonagenarian is facing a felony charge after police say he touched a 15-year-old neighbor at his apartment building on Friday.

Police arrested Roberto Gutierrez, 92, on a charge of lewd and lascivious conduct of a child under 16 Saturday.

The exact incident location was redacted from the Miami Police Department arrest report; it states that it occurred within a zip code that covers portions of the Liberty City and Little River neighborhoods.

According to the report, the teenage boy told police that at around 4:20 p.m. Friday, Gutierrez “was looking at him” as he walked into his apartment and, shortly afterward, knocked on the door.

The boy told detectives he opened it because he thought it was his father, police said. Authorities said Gutierrez “then used his walker to push the door open and made his way inside the victim’s apartment.”

Police said once inside, Gutierrez “then touched the victim on the left shoulder and arm while telling him he was beautiful, which caused the victim to (freeze).”

Authorities said Gutierrez walked toward the living room and told the boy to “sit on the couch”; the teen refused.

“The victim stated that he told (Gutierrez) that he had to go to soccer practice in (an) attempt to make him leave,” the report states. “The victim stated that while (Gutierrez) was in between the front door and hallway, (he) attempted to kiss him on the lips by leaning forward towards him, however, the victim backed up to evade the kiss. The victim then pushed the door close to get (him) out of his apartment.”

Authorities said Gutierrez would later tell detectives that he went to the victim’s apartment that day to ask for someone.

Police said he admitted he “touched the victim on the arm” but said he “never told the victim he was beautiful nor attempted to kiss him.”

Gutierrez, a Cuban national, was being held at the Metro West Detention Center on a $2,500 bond and a magistrate hold as of Monday afternoon, according to online jail records.
