MARGATE, Fla. – Police arrested a Margate man on a hate crime charge early Thursday morning after they said he threatened a Black man with a gun after he incorrectly believed he was on his property — and called him a racial slur while doing so.
According to an arrest warrant, the incident happened at around 8 p.m. Wednesday outside the home of Brian Francis Xavier Nobert, located in the 800 block of Southwest 54th Avenue.

Police said Nobert, 62, exited his home naked and brandished the gun.
A witness said he heard, “Get off my property, n-----,” and the victim told police said he heard Nobert say “Get off my property, you Black,” police said.
The victim said he heard a “click clack” noise, which he believed to be Nobert racking the gun, the warrant states.
“The victim, fearing he was going to be shot, fled to a nearby residence and notified police,” Margate Police Department Detective Joshua Baer wrote.
Police said they determined that the man was not on Nobert’s property and was, in fact, in the roadway.
Authorities said when they apprehended Nobert, he kept telling police he had “suicidal thoughts” and said “that police will have to come in and take him and there will be a gun battle.”
Nobert, facing charges of aggravated assault with a deadly weapon and committing a third-degree felony with evidence of prejudice, was being held in the Broward Main Jail on a $10,000 bond as of Friday evening.
