MIAMI-DADE COUNTY, Fla. – A Miami man was arrested Thursday after Miami-Dade police said he posted a video of a naked woman on Instagram.
According to his arrest report, Bernardo Marte, 35, and the victim had been dating for about two months in December when she went to his home where they engaged in consensual sexual acts.

Police said the woman, however, wasn’t aware that she was being filmed on his cellphone.
According to the report, the next day, Dec. 4, Marte texted the victim a video, which showed her naked.
Police said the victim told Marte to delete the video and refrain from showing it to anyone.
But a mutual acquaintance told the victim on Dec. 5 that Marte had posted the video to his Instagram Stories and that it had been up for 19 hours.
According to the arrest report, the victim reported the suspect to police, who then sent a preservation letter to Meta to preserve Marte’s Instagram Stories as they obtained a search warrant.
Police said the warrant was executed on Monday and the investigating detective discovered five Instagram Stories that depicted the victim engaging in sexual acts with Marte.
Marte was taken into custody Thursday at his workplace in Miami Lakes and transported to the police station for questioning.
Police said Marte initially denied posting the videos to his Instagram account, but when told that they had already executed a search warrant on his account, he responded, “I want a lawyer.”
Marte was arrested on charges of video voyeurism and sexual cyberharassment.
As of Friday, he remained held at the Turner Guilford Knight Correctional Center on a warrant for an unrelated case.
According to jail records, Marte was out on felony bond at the time of his arrest.
