MIAMI SHORES, Fla. – A man who is accused of driving drunk before killing a motorcyclist Sunday in a wrong-way wreck appeared in bond court Monday.
Carlos Humberto Fabian, 36, is facing charges of DUI, DUI causing serious bodily injury and DUI causing damage to property/person.
The judge said in court that toxicology results have not been received by the court yet, although the arresting officer noted in an arrest report that Fabian had bloodshot/watery eyes and his breath smelled heavily of an alcoholic beverage.
Police said Fabian failed a field sobriety test and multiple blood samples were taken at about 5:50 a.m., 9:40 a.m., and 10:40 a.m.
According to Capt. Christine Herbert, of the Miami Shores Police Department, police officers spotted the fiery crash after 3:05 a.m. Sunday, near Barry University. Miami-Dade traffic homicide detectives investigated it.
According to Detective Argemis Colome, a spokesman for the Miami-Dade Police Department, Fabian crashed his vehicle into a car and a motorcycle on North Miami Avenue, near Northeast 108th Street.
Fabian’s Volkswagen Jetta erupted in flames after the crash.
Fire rescue personnel declared Bobby Jenkins -- the motorcyclist -- dead at the scene and took Lindsey Laquerre, the motorcyclist’s passenger, to Jackson Memorial Hospital’s Ryder Trauma Center.
“He has a son -- he has sisters and brothers,” Jenkins’s mother, Judy Maffett, told Local 10 News.
Laquerre had a broken pelvis, broken femur and a head concussion, according to police. Laquerre’s brother told Local 10 News on Monday that she is having surgery on Tuesday.
Detectives accused Fabian, a North Bay Village resident born in Guatemala, of driving northbound on the southbound lanes. According to police, Alain Louissant, an Uber driver traveling southbound, reported that the Jetta collided with his Hyundai first before the head-on crash with the motorcycle.
He said Fabian apologized to him afterward for causing the crash.
According to police, during the investigation, detectives found a woman’s cellphone inside the Jetta.
Police said the woman wasn’t in the car, but she claimed that Fabian was drinking alcohol with her off and on from about 3 p.m., on Saturday, to about 2 a.m., on Sunday, while the two were on a date.
“It’s pain and I have to forgive, but he has to pay -- he has to pay and everybody has to pay for what they do and they can never replace my son,” Judy Maffett said.
“He was a very ambitious young man. He was a family man and always there when we needed him,” Jenkin’s father, Sam Maffett, said. “I offer forgiveness to the young man and may God have mercy on his soul.”
Fabian is being held in lieu of a $2 million bond.
He has been ordered to surrender his passport or travel documents and will be placed on house arrest if he posts bond.
