Hialeah PD: Woman arrested after toddler not restrained in car seat was seriously injured in crash

HIALEAH, Fla. – A 53-year-old woman was arrested Tuesday by Hialeah police after a 3-year-old child who was sitting in the backseat of the car she was driving was seriously injured in a crash.

According to her arrest report, the crash occurred just before 10:45 a.m. Tuesday in the area of East Fourth Avenue and 33rd Street.

Hialeah police said Sonia Margarita Vivas Castillo, of Miami, made a left turn in front of another vehicle at the intersection, even though she did not have the right of way.

According to the report, the impact of the crash caused Vivas Castillo’s car to rotate 180 degrees before coming to a final rest.

Police said officers arrived at the scene and found the toddler in the backseat of Vivas Castillo’s vehicle, going in and out of consciousness.

Police said the child was not securely buckled in a car seat, but was just sitting in the rear passenger side of the vehicle, unsecured.

According to the report, the toddler suffered a skull fracture and brain bleed.

Police said records revealed that Vivas Castillo had never been issued a driver’s license.

She was arrested on charges of driving without a license, causing serious injury and child neglect with great bodily harm.

According to the arrest report, the victim remains hospitalized and is expected to undergo surgery for the injuries sustained in the crash.

Police did not specify the relationship between Vivas Castillo and the victim.
