Miami-Dade police say the shooting occurred the morning of March 10, 2019, at the couple’s home in the Oasis gated community near Southwest 47th Street and Southwest 67th Avenue.
According to her arrest warrant, officers from the police department’s Kendall District responded to the scene after Martinez called 911 and found the victim, Osmanny Montano, 34, lying on the stairwell, with gunshot wounds to his chest and neck.
He was pronounced dead at the scene at 8 a.m. by Miami-Dade Fire Rescue.
According to the warrant, Martinez told the 911 operator that her husband “attacked her” and she “shot him.”
She claimed that he got up after being shot and came at her again, at which time she shot him a second time, the warrant stated.
Police said Martinez walked out of her home and was met by responding officers, who detained her for questioning.
According to authorities, Martinez claimed that the couple had been sleeping in different bedrooms because Montano was having a PTSD episode because he was a U.S. Army veteran.
Police said she claimed that prior to the shooting, Montano screamed at her and then began hitting himself and threw keys at her.
Martinez claimed she then went upstairs and grabbed her gun before sitting on it in the bedroom, authorities said.
Police said she claimed Montano then went into the room and noticed the gun and the two got into a struggle for it.
According to the warrant, Martinez said she shot her husband as he was on top of her. She claimed she then shot him a second time when he came at her again, authorities said.
“‘The Subject’ acknowledged that although ‘The Victim’ was ‘aggressive and scary’ he had never really hit her before,” the warrant stated.
Police said the shooting occurred in front of Martinez’s then 2-year-old son.
According to the warrant, detectives later discovered that Martinez had shot her husband while the gun was concealed inside of a folded pillow, which contradicted the claims she made.
“The trajectories of the gunshots, the lack of stippling or soot surrounding the gunshot wounds and the location of the blood evidence in relation to the projectile strike on the closet door” also refuted Martinez’s claims, authorities said.
As of Friday, Martinez was being held without bond at the Turner Guilford Knight Correctional Center. If she is convicted of murder, she could face the death penalty or life in prison.
