Man faces federal charges in Miami over sex with inmate at halfway house

MIAMI – A 60-year-old Miami-Dade County man pleaded guilty on Wednesday in Miami federal court to abusive sexual contact with a federal inmate who was confined to a halfway house.

Benito Montes de Oca Cruz worked as a site supervisor for Riverside House, a Federal Bureau of Prisons contractor in Miami, when he engaged in the sexual acts, according to prosecutors.

The victim was a woman who was serving part of her 51-month prison sentence in home confinement under Montes de Oca Cruz’s authority, according to prosecutors.

After receiving a tip, investigators with the U.S. Department of Justice’s Office of Inspector General found video and DNA evidence, according to prosecutors.

Montes de Oca Cruz’s sentencing before U.S. District Judge Robert N. Scola is on April 14, 2023. He faces up to two years in prison.
