No charges have yet been filed against man accused in CVS shooting

Police say man killed in shooting may have been trying to rob gunman

DAVIE, Fla. – No charges have been filed at this time against a man who shot another man Wednesday at a CVS in Davie, authorities said.

Police said the victim, Andre Smith, 20, met up with Matthew Jay Barry, 38, in the parking lot of the CVS on Griffin Road and University Drive to sell Barry an iPhone 7 for $280.

Police said the exchange was made, but at some point, Barry became uncomfortable and tried to leave.

Detectives believe Smith and an accomplice had plans to take back the phone and keep Barry's money. 

Authorities said the two men argued and Barry was blocked from leaving the parking lot in his vehicle.

Police said Barry warned Smith that he was armed, and Smith and his accomplice claimed they were armed, too. 

Authorities said Barry then retreated inside of the CVS and yelled for employees to call 
911.  

Surveillance video shows Barry trying to get away from Smith, authorities said.

Police said the incident soon turned physical and Barry pushed Smith away and fired several rounds at Smith.

Smith was taken to a hospital, where he died.

No charges have been filed against Barry, and police say their investigation is still active and open.

Authorities are not ruling out self-defense, but say they will eventually hand over their information to the State Attorney's Office for a final review.
