They said Clay Miller, 50, who had shared custody of Austin, was supposed to turn over the boy to his mother the same day she arrived, but instead, he took off with the child.

Deputies said Miller was taken into custodyĀ in Miami with assistance from the FBI, Florida Department of Law Enforcement and Miami Beach police.Ā

Austin is safe and will be reunited with his mother, authorities said.Ā Ā

Austin's mother, Michelle Granado, told Local 10 News that Miller was supposed to drop Austin off at the airport Aug. 7, where she was waiting to take him back to California.

"An hour prior to our departure, I'm texting him, 'Where are you? I'm at the curbside,' and no response," Granado said. "I called their cellphones ... and the phones were completely turned off."Ā

Granado said Miller has run off with their son before, but returned after a couple of days.Ā

"He did the same thing in April, and I had to go to Florida to pick up Austin, and he never showed up in April, and I had to go the courts," she said.Ā

Granado said a court hearing was scheduled for this month regarding the custody agreement.Ā
