CORAL GABLES, Fla. – No charges will be filed against the ex-girlfriend of former Miami-Dade County Mayor Carlos Alvarez, who police said was caught breaking into Alvarez's apartment in Coral Gables.
Prosecutors appeared Tuesday in court, where they said "no action" will be taken by the state in the case.
According to Coral Gables police, Miami-Dade police Lt. Evelyn Fernandez was arrested July 17 after a witness said he saw her in the pool area of the building on Merrick Way, hitting a rear window of the apartment with a floor tile and then throwing the tile into the pool.
Police said there was no forced entry into the apartment, and Fernandez does not have a key to the property.
Fernandez claimed to be at the home to pick up her belongings, police said.
Police said Fernandez damaged thousands of dollars' worth of items inside the apartment.
The damaged items included glass sculptures, a wall unit and a metal piece of artwork, which fell on Fernandez's leg, causing a cut, police said.
Fernandez was arrested on charges of burglary to an unoccupied structure and criminal mischief.
The former mayor and his ex-girlfriend made headlines in April when he was arrested on a battery charge after a fight about a cat escalated in the parking garage of his apartment building. Police said Alvarez grabbed Fernandez, pinned her against a wall and spit on her.
The Miami Herald obtained an audio recording of Fernandez's statement to detectives, where she claims that Alvarez's violent behavior began in 2013 when he got into body building.
Fernandez claimed that Alvarez took steroids and that he became verbally and physically abusive.
When asked if she was afraid of her ex-boyfriend, Fernandez said, "Yes. When he gets into his rages? Yeah, I'm completely terrified of him because he's not thinking rationally and you can't talk to him. Nothing makes sense to him."
Alvarez pleaded not guilty to battery. His case was dismissed as well when Fernandez failed to testify at a hearing.
Miami-Dade police said Fernandez is on paid leave pending an internal investigation regarding her arrest.
