Former condo president pleads no contest to battery

SUNRISE, Fla. – Stephen Smith has alleged the board at Waterbridge Condominiums in Sunrise squandered reserve funds, but that's not all.

When a fire gutted the unit directly above his, causing water damage to his own condo, Smith sued for damages after it took years for the board to get the repairs.

He's been on a years-long hunt to get into the condo's books, which he said have been illegally denied to him.

"The more I dug the worse the harassment got, and it became violent," he said.

Smith shared a video of a board meeting with Local 10 News during which he was attacked by the board president at the time, Jacqueline Chance. Smith said she became enraged when the subject of Smith's lawsuits was raised and after Smith mentioned a bathroom renovation that was done at her condo.

"It didn't come from you (expletive)s," she screams at Smith before she strikes him in the face, knocking off his glasses.

She's restrained and attacks again, before berating Smith.

"The word (expletive) suits you!" she yells. "You are an ignorant low-class bastard!"

Chance would plead no contest to battery and Smith has sued for damages. She was the second board member to attack Smith; Luis Rios pleaded out to battery in late 2006 in an even more violent and bloody attack during a condo-related argument that required Smith to receive medical attention.

"We had words but his words became fists," said Smith.

Then there's another former board president, Marvin Feuer, whom Smith said he caught holding secret meetings, one of which he caught on audiotape.

"They pretended the meeting was over and it wasn't," Smith said.

On the recording, Feuer can be heard instructing the board secretary to destroy audiotapes of the board meetings to keep Smith from getting them as evidence.

"Do not use those tapes as records, because Stephen Smith will require that we produce them," says Feuer. "Write over it. If he knows you're keeping them, he'll request them."

"It was an intentional act to destroy the tapes," said Smith.

On the same tape Feuer admits he once pulled a gun on Smith, something he says occurred back in 1999.

Smith claims the board has retaliated against him on a regular basis and in a videotaped deposition, Feuer admits he arbitrarily made sure Smith was last on the list for new windows and doors.

Smith: "I was last on the list?"

Feuer: "Yes."

Smith: "Completely out of sequence?"

Feuer: "Yes."
